    The Supreme Court has strongly criticised the culture of the acting DGP and noted that state governments are in violation of the Prakash Singh guidelines. The apex court has asked the UPSC to ensure compliance with the Prakash Singh Guidelines to curb the practice of acting as DGPs.  The SC has also empowered the UPSC to write to state governments seeking timely proposals for selecting DGPs and to approach the court if states delay DGP appointments. 

    The CJI-led bench said, "We authorize the UPSC to write to the States to send timely proposals for recommendations of respective DGPs whenever such occasions arise. When such proposals are not sent, we direct the UPSC to move an application in the Prakash Singh case. It goes without saying that necessary consequences, including accountability of the concerned States, will be taken up,"   

    Currently, the Tamil Nadu, Uttar Pradesh, and West Bengal Police are under acting DGPs, while the Jharkhand police is under a DGP whose regularisation is questionable and not in accordance with the Prakash Singh guidelines.
